By downloading, installing, or using the Primary mobile application (the “App”) and any related services (collectively, the “Services”), you agree to these Terms and Conditions (“Terms”). Please read them carefully.
Eligibility
You must be 18 years or older (or the age of legal majority in your jurisdiction) to use Primary.
If you are under 18, you may only use the App with the consent and supervision of a parent or guardian.
Nature of the Service
Primary is an AI-powered health application developed by 78Health to help users track health data, assess potential risks, and receive lifestyle guidance.
It does not provide medical advice and is not a substitute for consultation, diagnosis, or treatment from a licensed healthcare professional.
Primary is not suitable for emergency use. If you think you may have a medical emergency, call your local emergency number immediately (e.g., 911 in the U.S. and 100 in India).
User Responsibilities
By using Primary, you agree to:
- Use the App only for personal, non-commercial purposes.
- Not misuse the Services, including by attempting to reverse-engineer, hack, or disrupt our systems.
- Follow all applicable laws and regulations in your jurisdiction.
Data and Privacy
Your use of Primary is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
By using the App, you consent to such data handling in accordance with our Privacy Policy.
Health Data
Primary may integrate with third-party devices and services (e.g., wearables, labs) to collect health-related information.
We do not guarantee the accuracy, completeness, or reliability of third-party data sources.
Intellectual Property
All intellectual property in the App, including but not limited to text, graphics, logos, AI models, and software, is owned by or licensed to 78Health.
You may not reproduce, distribute, or create derivative works without our express written permission.
Subscription, Fees, and Payments
If you purchase a subscription or other paid features:
- Fees will be charged in accordance with the pricing displayed in the App.
- Payments are processed through app store payment systems (Google Play, Apple App Store) and subject to their terms.
- We reserve the right to change pricing with reasonable notice.
Disclaimers
The App is provided “as is” without warranties of any kind, express or implied.
We do not guarantee uninterrupted, secure, or error-free operation.
Any reliance on the App’s suggestions is at your own risk.
Limitation of Liability
To the maximum extent permitted by law:
- 78Health will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the App.
- Our total liability for any claim will not exceed the amount you paid to us in the preceding 12 months.
Termination
We may suspend or terminate your account if you violate these Terms, misuse the Services, or engage in fraudulent or harmful activity.
Governing Law
These Terms will be governed by and interpreted in accordance with the laws of California, USA, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time.
Material changes will be notified via the App or email. Your continued use of the Services after changes means you accept the updated Terms.
